The Basic Regulation is the foundational regulation which sets the legal basis for the creation of the European Union Aviation Safety Agency, EASA. It defines EASA’s legal authority, and establishes a set of basic, common, aviation safety requirements.
The Basic Regulation was first legislated in 2002, and has gone through a number of changes in the last twenty years. In the last decade, increasing air traffic, aviation’s impact on the environment, the rise of unmanned air systems and the impact of global digitalisation, called for a revision of the regulation. The European Union felt the need to prepare its regulatory framework for the challenges of the next 10 to 20 years, to ensure the safety and security of passengers’ mobility and the general public.
The New Basic Regulation, Commission Regulation (EU) 2018/1139, entered into force on the 11th of September 2018. The regulation covers the full spectrum of the aviation landscape, to reinforce the European aviation system as a whole.
You, as an aspiring or experienced professional, should know the foundational principles behind the Basic Regulation before you further your knowledge in other areas of the regulation. As you know, regulations form the boundaries of our daily work, to keep our operations safe.
After the course, you will be able to outline the basic features of the Basic Regulation, be aware of its parts, and be aware of where to find the parts which may be relevant to you.
We will start by defining the Basic Regulation, and go through a short overview of its history. We will then outline its objectives, and review a new concept which has been introduced in the latest Basic Regulation: Opt-ins and Opt-outs. We will then shortly define the differences between Implementing and Delegated Acts.
We will finish by defining the role of EASA, and establish where to find the Basic Regulation.
